1. General Provisions

Fentrica values the privacy of its Clients’ data. This Privacy Policy describes how Fentrica processes the personal data of its Clients, Client representatives, Users, and other data subjects (you) in relation to the use of the Fentrica Platform and Services. This Privacy Policy applies when you use, have used, or have expressed an intention to use the Fentrica Platform and Services, including trial or demo versions. It also applies to our potential Clients. All capitalised terms in this document shall have the meanings assigned to them in our Terms of Use.

2. Data Controller

The data controller of personal data is Fentrica (Legal entity Fentrica OÜ, business registry number 14685154, address Siduri 3, Tallinn 11313). For inquiries regarding personal data, you may contact us via email at hi@fentrica.com.

3. Collection, Processing, and Storage of Personal Data

For data uploaded by Clients and Users to the Fentrica Platform or generated through the use of the Fentrica Platform, Fentrica acts as a data processor, while the Client is the data controller.

Fentrica processes Client Data based on:

  • The Client’s or potential Client’s consent to the processing of their data,
  • The necessity to process data for the performance of a contract, and
  • Fentrica’s legal obligations.

Fentrica processes personal data in a lawful, fair, and transparent manner.

Fentrica collects personal data for legitimate purposes and does not process it in a way that is incompatible with these purposes.

If you are a Client, Fentrica primarily processes your personal data to enter into and perform a contract with you. This includes providing customer support and contacting you for reasons related to the Platform and Services.

We may process the following personal data:

  • Name,
  • Work email address,
  • Work phone number,
  • Client company,
  • Job title at the Client company,
  • Communication data,
  • Data related to the use of the Fentrica Platform and Services.

If you are a potential Client (trial or demo user, marketing prospect, or their representative), we process your personal data for marketing purposes and to encourage your company to enter into a contract with us.

Additionally, we may process your personal data to protect our rights (e.g., to establish, exercise, or defend legal claims).

We do not process special categories of personal data. In accordance with our Terms of Use, the Fentrica Platform and Services are not intended for individuals under 18 years of age. Therefore, we do not process the personal data of minors.

We collect your personal data in the following ways:

  • You provide us with your personal data directly,
  • Your personal data is provided by a Client representative or another User,
  • Your personal data is provided by a third party (e.g., when a third-party payment service provider confirms whether your payment was successful).

We may also process your personal data based on your consent (e.g., for direct marketing purposes). If processing is based on consent, you may withdraw your consent at any time by contacting us or by clicking the “unsubscribe” link at the bottom of any marketing email.

We use the following categories of data processors:

  • Data collection, management, and storage providers,
  • Email service providers,
  • Messaging service providers,
  • Customer relationship management and feedback service providers,
  • Direct marketing service providers,
  • Payment service providers,
  • Accountants,
  • Electronic communication networks and service providers,
  • Security technology and service providers,
  • Legal and other consultants.

4. Security

We implement technical and organisational security measures to protect your personal data, taking into account:

  1. The state of technology,
  2. Implementation costs,
  3. The nature, scope, context, and purposes of processing,
  4. The risks to your rights and freedoms.

5. Data Subject Rights

Data subjects have the right to request:

  • Access to their personal data,
  • The right to review and obtain information about the processing of personal data,
  • Rectification, erasure, or restriction of processing of their personal data,
  • The right to object to data processing.

If personal data processing is based on consent, the data subject has the right to withdraw their consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

Data subjects also have the right to lodge a complaint with a supervisory authority, which in Estonia is the Data Protection Inspectorate.

6. Final Provisions

This Privacy Policy has been prepared in accordance with:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR),
  • The Estonian Personal Data Protection Act,
  • Other applicable Estonian and EU laws.

If our personal data processing practices change or if this Privacy Policy needs to be updated due to changes in applicable data protection laws, other relevant legislation, court rulings, or guidelines issued by competent authorities, we reserve the right to unilaterally amend this Privacy Policy at any time.

In such cases, we will inform you via email reasonably in advance before the changes take effect.
